Would be interested in hearing from anyone who recently left SB to go to a non protocol firm. Smaller producers, say 300-400k.
Did you follow the protocol anyway in terms of what you took with you? What was your exoerience? Did SB make it tough for you? Were there legal issues? TRO? Did you have a non solicit in place that you had to worry about, and if so was it enforced?

No to all your questions.  My old SB office is five floors below mine, and we still go out for lunch a few times a week.
I do have friends who left in 2007 and summer of 2008 who got notices where they had to pay back money, but I haven’t.  I left quite a few accounts behind, and only brought over the ones I wanted.  No hassles at all.  In fact, a couple of the SB SA’s were so accommodating I bought gift certifcates for them.

SB is one of the firms that has been taking advisors leaving personally and filing TROs even when the Protocol is followed.  I do not think you should ignore the Protocol when you leave.  I actually advise clients to give a hard copy of the material you are taking with you with your resignation letter.   Most of the cases are in arbitration currently so it is hard to know the outcome.  I cannot beleive that SB will win if advisors do things correctly.
