I left my firm and have a “no solicit” agreement with some split accounts. I offered $$$$ to my partner who turned it down thinking he would keep all the clients. Obviously there are clients who would choose to have myself as the FA. My question is what is considered a solicitation?   



An outgoing call?



A letter informing only of new add and phone?



An email with add and phone?



A call to the son/daughter of wealthy client?



I don’t want to cross any lines. Thanks for your opinions.

Why is it so hard for you to not do what you agreed not to do?

Well, your answer is not exactly helpful. I don’t want to bend or break any rules. That being said, in this modern time clients will call me on my cell phone when they hear the news. Here is the conversation:



Client: Hi, I heard you left.



Me: Yes, I moved to a different affiliation.



Client: Well, can we move our account with you?



Me:???

If they call you, you are not soliciting them.

I think you’re confused about my answer. It’s not an answer, it’s a question.

Senior Broker: Hello, Mr. Client. This is Senior Broker. I just wanted to let you know that Tampon is no longer working here. We are in the process of auditing all of his transactions and accounts for irregularities. We don’t believe that your account has been one of the mismanaged accounts, but we want to make sure. In the meantime, call me if you need anything. I’ll be burning the midnight oil all week and will be able to respond promptly.
