Goes into a slump and can't get out of it is fired for lack of production.  -  So, let's say you are the RL.  You have an office that isn't producing for whatever reason, divorce, drugs, alcohol, laziness, etc.  What do you do with it?  Let it go.  If the guy isn't producing he's going to eventually lose AUM and cost the firm $$.  I'll bet it didn't just happen overnight.  He had to go into serious lack of production ($7K-8K gross/month) for a long period of time before Jones puts him on goals and then terminates him.  I'm suprised they didn't offer him a home office job that wasn't production related until he could get his head back into the game. If he was that great of a producer they probably would have put at TR in the office to keep things going until he was ready to step back in.    

The women I mentioned earlier wasn't in a coma she had a surgery, and was only gone from her office 3 days.  - Sorry, I don't buy it.  I could be gone this whole week and Jones wouldn't care. In fact I went to Disney World with my kids this spring and I didn't get fired for it.  I didn't even have to tell anyone I was going.  There's more to that story than what you're telling or you just heard a small part of the story.   

Whatever reason you think EDJ is justified in getting rid of these people is an excuse to grab the assets of the office and realocate them to other IR's who lick the butts of the powers that be.

Jones doesn't just fire people.  You almost have to go out of your way at Jones to try to get fired.  I've seen it at the home office and I've seen it in the field.  People can do next to nothing for a long time and Jones will give them a second chance.  Out of the thousands of FAs they've hired over the years I'm sure there were a few terminations that looked weird to an outsider, like the woman who had surgery, but they are definitely the minority.  There are a few things that will get your butt canned pretty quick, but they'd get you canned almost anywhere.

Oh…Spiffy…don’t think they didn’t know you were gone…They know…they know everything about you…they can run a program on what key strokes you run…how many times you type COMM on the green screen…when the toilet flushes…they’re on to you…big time…I wouldn’t drive the same way to and from home…Just lookin out for ya…Spiff…wouldn’t want you to…suddenly…VANISH!

Okay Okay Lets get back on topic here people.

What is going to put on my U5?  How is that going to effect me future employment?  I know they have 30 days to report my U5 but does anyone know how long they usually take?

Sixty days--the fine for failure to file in thirty days is something like $25.

Contact your former manager and ask them to send you a copy when they file it--you have the right to see it.

Did you burn your bridges totally? I know it sounds weak but is there anyone that you could contact that could give you more information.

You know I even googled it and didn't find an answer. Try PM'ing the lawyer on here. He probably would have an idea.

Wait though... The best line of this whole thread was

Usually if you don't have any other dings/complaints on your U4 and you can fully document that this dismissal is/was inconsistent with your past performance and conduct, you shouldn't have any problem getting on at another firm (indy or otherwise). I have seen brokers near criminal status get good positions at other firms despite their previous convictions. Advice - get good legal representation just in case.

Okay. Thanks for the responses.  I have a clean U4.

What does anyone know about the amount of time they will seek for a TRO if they terminate someone?  Do I have any recourse in asking them to file the U5 any sooner?

You may must want to confirm it. What used to be “by request only” is now up for public display on the NASD website. I learned a lot! All those "maybe"s of the past are now available for the world to see!

What is it that we are always told?

"You run a profitable, ethical, and legal business and you have nothing to worry about."  Did I get that right?

I have to wait for EJ to file my U5 before I can be hired by any other firm or so I am being told.

U-5 cleared today. 

Any others terminated that can give advice going forward?  I will be going the independent channel within the next few days.  I want to avoid the temporary restraining order that is coming if at all possible.
