Leaving U5 Unemployment

It appears I will be leaving my position due to "lack of production." Since I'm not resigning first is there any real difference between "discharged" or "permitted to resign"? Should "permitted" be offered what is the effect on unemployment insurance if that is chosen?

I’m not an attorney, nor did I sleep at a Holiday Inn Express last night, but here’s what I know…from personal experience. 

1.  Nobody cares if it says you left for failure to reach production goals - if you have a viable book that you can access and/or a work ethic that will attract another employer, that’s all that will matter.  90% of the people in this industry that leave, do so because of “Failure to attain production goals.”   

2.  It’s a helluva lot easier to beat/argue/ignore the no compete you signed if they let you go versus if they “give you an opportunity to resign.”  DONT DO IT!!!  Let 'em terminate you…IT JUST DOESN’T MATTER.  (THAT…is from personal experience.)

Again…this is not legal advice…everyone told me all of the above before I left my last employer…and I didnt believe them till I finally talked to an attorney…now I’m all better and free of the B/D chain around my neck.

Oh yeah…don’t forget to register for unemployment benefits as soon as you can.  You paid into 'em…now’s the time to get them back!
