Merrill TRO story

I'm not picking on Merrill too much but doesn't the fact the they actively recruit and ask others to work around those recruits non-competes qualify for case dismissal when they trump up these TRO requests?

When is this hypocrisy going to be addressed and concluded?

Coerced employment agreements shouldn't trump the basic principle that neither clients or producers are "owned" or "trade secrets".
